Aims

  • To develop legal skills and knowledge of managers of Human Resources in current and strategic issues
  • Develop in depth knowledge and understanding of managers of the  impact of legal rules on management HR strategy
  • To equip managers with skills and abilities to implement and develop HR policies while minimising legal liabilities
  • To create an awareness of new and developing legal policies and their impact on the HR function

Syllabus

Each year current and imminent developments relevant to the aims of the module will be selected from the following list

Individual
The scope of employment legislation and the relevance of the contract of employment and the development of judicial tests  of identification
How the law permits/restricts management responses to organisational change
Expansion by acquisition – share or asset transfers and TUPE
Unfair dismissal – strikers and those who take industrial action
Employment Tribunals – their ethos and future developments
Impact of EU law on the HR function in particular Working Time Regulations
Liability for workplace stress and how managers can avoid it

Collective
The role of the collective agents and Trade unions
Liability for industrial action and statutory immunity – the employer’s strategies –interdict and injunction
Statutory duties to recognise and information and consultation requirements - a duty to bargain in good faith?
Freedom of association (ECHR) and its impact on the UK law of collective bargaining

Learning Outcomes

Subject Mastery

  • Develop in depth understanding of relevant areas of UK and EU Employment Law –  individual and collective  - and how to develop HR strategies which are consistent with the legal principles
  • Develop awareness of the impact of UK and EU principles on HR management strategy
  • Appreciate the role of the law as economic and labour policy
  • Analysis of  case law, reports and journal articles and statutory provisions
  • Develop ability to formulate HR policies in the context of current legal developments
  • Develop ability to analyse problems in workshops,  course work and examination.

  • Ability to discuss complex issues and develop skills in report writing and analysis
